These Terms of Use govern access to nacar.ai and Nacar’s services. Nacar.ai is operated by Pedro Torrecillas, operating as Nacar.ai (“Nacar”, “we”, “us”). Questions may be sent to support@nacar.ai.

1. Introduction and definitions
“Services” means Nacar’s website and its recruitment and pre-screening administration services. “Website Visitor” means a person browsing the public website. “Organisation” means a customer, sponsor, CRO, site or other entity using the Services. “Professional User” means an individual authorised by an Organisation. “Participant or Candidate” means an individual using or contacted through a candidate-facing flow.
2. Acceptance, capacity and authority
These terms apply when a person accesses or uses the Services. Contact alone does not constitute acceptance. A person accepting or using the Services for an Organisation represents that they have authority to bind it. Candidate-facing flows are used only by persons with legal capacity, or through a lawful process involving an authorised representative where required. If you do not agree to these terms, do not access or use the Services.
3. Document hierarchy
A signed customer agreement, order form and data processing agreement control the business-to-business relationship to the extent they conflict with these terms. Study information and an informed-consent process govern participation in a study. The Privacy Policy provides privacy information and is not consent to data processing, contact or research participation.
4. Description of Services
The Services support recruitment and pre-screening administration, outreach, organisation of protocol and interaction evidence, scheduling, and follow-up. Service features are configured for the Organisation and the relevant study workflow.
5. Clinical limits and emergencies
The Services do not provide medical advice, diagnosis or treatment and do not create a care relationship. They are not for emergencies; contact emergency services or a qualified clinician in an emergency. Nacar does not guarantee eligibility, enrolment, a study place, treatment or any clinical outcome. The responsible study team verifies information and makes clinical, eligibility, participation and enrolment decisions.
6. AI and human oversight
AI-assisted tools can extract and organise protocol or interaction evidence, generate questions, prepare summaries, and show criterion-level coverage or status. An AI-assisted interaction is disclosed at its start. Such tools can be inaccurate or incomplete and are subject to meaningful human review. Nacar does not autonomously determine eligibility, participation or enrolment and does not make final eligibility, participation or enrolment decisions solely by automated means.
7. Candidate responsibilities and participation
Participation is voluntary. Candidates should provide information that is accurate to the best of their knowledge, follow the relevant study team’s instructions, and may stop non-essential communications using the available opt-out method or by contacting the sender. Contact or use is not informed consent and does not guarantee participation or an outcome.
8. Organisation responsibilities
Each Organisation is responsible, according to its role, for its authority to use the Services; applicable legal bases, notices and permissions for contact and recording; approved and accurate protocol, study and configuration information; Professional User access; and handling or routing data-subject requests. The responsible sponsor, investigator or study site remains responsible for clinical, ethics and regulatory compliance and for final study and clinical decisions.
9. Accounts and security
Professional Users must keep credentials confidential, use accounts only as authorised, maintain accurate account information, and promptly report suspected unauthorised access or misuse. Organisations are responsible for their users’ access and actions within their accounts.
10. Acceptable use
You must not misuse the Services; impersonate another person; circumvent security or access controls; introduce malicious code; scrape, reverse engineer or interfere with the Services except where law permits; upload unlawful content; infringe rights; or use data outside authorised study or business purposes.
11. Communications
Communications can use appropriate authorised channels, including calls, email, text, messaging services and WhatsApp. Required notices, permissions and opt-out choices apply to the particular communication, recording or transcription. Service notices may be sent through an account or to associated contact details.
12. Third-party services and integrations
Optional third-party services and integrations, including Google Calendar, are subject to their own terms, privacy notices and account-holder choices. Their content, availability and operation remain under the third party’s control.
13. Customer Data, privacy and confidentiality
As between Nacar and an Organisation, the Organisation retains its rights in Customer Data. It grants Nacar a narrow, non-exclusive technical licence to host, copy, transmit and process Customer Data only to provide, secure and support the Services under applicable instructions. Nacar protects Customer Data as confidential and does not commercialise it, use it for an independent purpose, or use Customer Clinical Data to train general-purpose models. The Privacy Policy and applicable data processing agreement govern personal-data processing.
14. Intellectual property and feedback
Nacar and its licensors retain all rights in the Services, software, documentation, branding and materials. Subject to these terms, Nacar grants authorised users a limited, non-exclusive, non-transferable right to use the Services for their authorised purpose. Feedback is voluntary, and Nacar may use it without restriction or compensation, provided it does not identify or include Customer Clinical Data.
15. Availability and changes
We use reasonable care to operate the Services, but availability can be affected by maintenance, security, telecommunications, third parties or events outside our control. The Services may change to maintain security, comply with law, improve operation or reflect a customer agreement. A material adverse change to a business service follows the applicable customer agreement.
16. Suspension, termination and data
Nacar may suspend access where reasonably necessary for security, misuse, legal compliance, material breach or prevention of harm, with reasonable notice where practicable. Organisation termination, data return, deletion and retention follow the applicable customer agreement, controller instructions and law. Individuals may stop using a candidate-facing flow and request an end to non-essential contact.
17. Disclaimers and liability
Study information, screening information and availability can be incomplete, inaccurate or change. Nacar does not assume responsibility for a study team’s clinical, ethics, regulatory or enrolment decisions. Any limitation of liability in a signed business customer agreement applies only to that business relationship. Nothing in these terms excludes or limits liability, remedies or consumer or participant rights that cannot lawfully be excluded or limited.
18. Governing law and jurisdiction
Spanish law governs these terms, without limiting mandatory protections available to a consumer under the law of their country of residence. Courts with jurisdiction under applicable law have jurisdiction over a dispute, including the mandatory courts of a consumer’s residence where applicable.
19. Changes, notices and general terms
We may update these terms and display the current version here. Material changes receive notice appropriate to the relationship, and acceptance is requested where law requires. Nacar may assign these terms in connection with a reorganisation, merger or transfer of the Services, subject to applicable law; users may not assign them without consent. If a provision is unenforceable, the remainder continues. A waiver must be express and does not waive later rights.
